Terms of service

Welcome to Seagull Sweets Co. By using seagullsweetsco.ca and placing an order, you agree to these terms.

Products: all items are handmade in small batches in Victoria, BC. Weights and piece counts are approximate, and product photos are illustrative. Flavours rotate and seasonal items are available only while they last.

Allergens: our kitchen handles dairy, wheat and gluten, tree nuts, peanuts, and soy. Every bag is labelled with its ingredients and allergens. Because everything is made in one small shared kitchen, any flavour may contain traces of any of these, including flavours that don't list them as ingredients. We cannot offer an allergen-free product. If you have a severe or life-threatening allergy to any of these, please don't order from us, and please don't eat our caramels if someone gives them to you as a gift. We would much rather lose the sale.

Orders and payment: all prices are in Canadian dollars. We may decline or refund any order (for example, if an item is unavailable or a price was listed in error). Taxes and shipping are calculated at checkout.

Cancellations: we make things fresh to order, so we can only change or cancel an order if it hasn't shipped. Email seagullsweetsco@gmail.com as soon as possible.

Returns and refunds: see our Refund policy. Edible items can't be returned. We replace or refund orders if we sent the wrong flavour, if they arrive damaged or incorrect, or if tracking shows they were lost in the mail.

Content: everything on this site (words, photos, illustrations, and the gull) belongs to Seagull Sweets Co. and can't be reused without permission.

Liability: to the extent permitted by law, our liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded, including your rights under the Business Practices and Consumer Protection Act and the Sale of Goods Act (British Columbia).

Governing law: these terms are governed by the laws of British Columbia and the federal laws of Canada that apply there, and the courts of British Columbia will have jurisdiction over any dispute.
